No One Regulates Lead in Dog Toys. Here Is How to Shop Around the Gap

Testing found 45% of pet products carried hazardous toxins, and there is still no federal limit for lead in a dog toy. The fix is not a law that doesn't exist. It is knowing which standards brands quietly follow.

Here is the uncomfortable truth in one sentence: the tennis ball your dog has been gumming all afternoon is held to a lower chemical-safety bar than a toy you’d hand a toddler, because for dog toys there is no bar at all. There is no federal limit on lead, arsenic, or any other toxin in pet products, and there hasn’t been for the entire time anyone has been asking for one.

Most coverage of this issue ends there, in frustration, waiting for a regulation that keeps not arriving. That is the wrong place to stop, because while the law has stalled, the standards around pet toys have actually moved, and a savvy shopper can use them. This piece is built around what you can do in the toy aisle today, not around a rule that may never come.

The standard your dog’s toys could meet (but legally don’t have to)

The reference point worth knowing is ASTM F963, the federal toy-safety standard for children’s products. As of April 20, 2024, the updated ASTM F963-23 became the mandatory standard for kids’ toys, and its chemical limits are the numbers to shop by: no more than 100 ppm total lead in any accessible part, and no more than 1,000 ppm (0.1 percent) of regulated phthalates. The European limit on lead is stricter still, having dropped to 23 ppm in 2018.

None of this is legally required for a dog toy. But that is exactly the lever. The smartest pet brands voluntarily build to the children’s-toy standard, and major retailers including Chewy, Petco, and PetSmart now reference ASTM F963 chemical requirements and CPSC guidelines in their own supplier codes, meaning some products on their shelves have already cleared that bar even though no government made them. Your job is to find those products, which is far more actionable than waiting for Congress.

How to shop the gap, concretely:

  • Look for language like “meets ASTM F963,” “tested to children’s-toy safety standards,” “lead-free,” or “phthalate-free.” A brand that has done the testing will usually say so, because it is a selling point.
  • Be suspicious of printed lettering, paint, and bright dyes on cheap balls and squeakers. In the testing below, the worst lead reading was in the lettering on a ball.
  • Favor simple materials: natural rubber, undyed canvas, or food-grade silicone over glossy painted plastics of unknown origin.
  • For chewers, replace toys as they break down. Degrading material is when interior components and coatings actually become accessible.
  • When in doubt, a toy genuinely made and marketed for human children is held to the mandatory standard, and dogs do fine with many of them (supervised, and minus small parts).

What the testing actually found

The reason this matters is not theoretical. The Michigan-based Ecology Center, a nonprofit that screens consumer goods for toxins, tested more than 400 pet products and published the results. The group is careful to note its screening “cannot identify the presence and concentration of every chemical of concern,” BPA among them, but the numbers are still striking:

  • 45 percent of the more than 400 pet products tested had detectable levels of one or more hazardous toxins, including arsenic, chlorine, and bromine, chemicals linked in studies to reproductive harm, developmental and learning problems, liver toxicity, and cancer.
  • 48 percent of tennis balls contained detectable lead, and balls made specifically for pets were more likely to contain lead than sporting-goods tennis balls. The lettering on one “pet” tennis ball measured a staggering 2,696 ppm of lead plus 262 ppm of arsenic, which causes cancer in humans. Every ball made for actual tennis players, meanwhile, came back lead-free.
  • One-quarter of all products had detectable lead, and 7 percent exceeded 300 ppm. Nearly half of pet collars had detectable lead, with 27 percent over 300 ppm.

“Pets are involuntary canaries in the coal mine in terms of chemical exposure,” said Jeff Gearhart, the Ecology Center’s research director. “Pets, like children, have higher exposure to chemical hazards, and our data show that pet products are far more likely to have hazardous chemicals than children’s toys.”

The history behind those numbers belongs to Nancy Rogers, a nurse and dog owner who, back in 2007, paid a lab to test 24 of her Sheltie’s chew toys. One tennis ball came back at 335.7 ppm of lead. At the time that fell below the children’s-toy limit; under today’s 100 ppm standard it would fail outright. “We can test and measure all we want,” Rogers said, “but until we have standards, it’s hard to evaluate what those levels mean.” Nearly two decades later, for pet toys, that is still true.

The counterargument, fairly stated

The pet-products industry has long pushed back, and the case deserves a hearing. “There are no indications that there is a real risk to pets from lead and other toxins in their toys,” said Ed Rod, a former vice president at the American Pet Products Association, noting that the trade group had received no reports of pets sickened by the lead or plastic in a toy. It is true that no published study has yet directly tied lead in dog toys to a specific canine illness, partly because no one has run that study.

The honest read is that absence of proof is not proof of safety, especially for a chewing animal with daily, mouth-first contact and for the small children who share a household with the toy box. The toxicologists who did the testing land in the same place: “For lead, the standard that applies for children’s toys is appropriate for pets,” Gearhart said. Until a law says so, that standard is yours to apply at checkout.

The practical takeaway

You do not need to throw out the toy box tonight, and you do not need a regulation to protect your dog. Read for the safety language brands now advertise, lean toward simple natural materials, retire toys as they wear, and treat the children’s-toy standard as your personal floor. The regulatory gap is real. Shopping around it is the part you control.
